Welcome to PopFerry. These Terms of Service ("Terms") govern your access to and use of popferry.com (the "Site") and any purchases you make from us. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

PopFerry is operated by ClickGear LLC, a Wyoming limited liability company. Throughout these Terms, "PopFerry," "we," "us," and "our" refer to ClickGear LLC.

1. Eligibility

You must be at least 18 years old to purchase from PopFerry or create an account. By placing an order, you represent that you are at least 18 and have the legal capacity to enter into a binding contract.

2. Account Registration

You can shop as a guest or create an account. If you create an account, you're responsible for keeping your login credentials secure and for any activity that happens under your account. Tell us right away if you suspect unauthorized access.

3. Products and Availability

Every PopFerry piece is made to order. We reserve the right to limit quantities, discontinue products, or correct pricing or product description errors at any time without prior notice. Colors and prints may vary slightly between screen and physical product due to display calibration and natural variation in the printing process.

4. Pricing and Payment

All prices are in US dollars and exclude applicable taxes, which are calculated at checkout based on your shipping address. Prices may change at any time, but the price you see at checkout is the price you pay for that order.

We accept major credit cards and other payment methods displayed at checkout. Payment is captured at the time of order. If your payment is declined or reversed, your order will be canceled.

5. Order Acceptance

Submitting an order does not guarantee acceptance. We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, errors in pricing or product information, suspected fraud, or violation of these Terms. If we cancel an order after payment, you'll receive a full refund.

6. Shipping

We currently ship to addresses within the United States only. Most orders arrive within 5 to 10 business days, with production taking 2 to 5 business days and shipping taking 3 to 5 business days. Detailed shipping information is available in our Shipping Policy.

We're not responsible for shipping delays caused by carriers, weather, or events outside our control.

7. Returns and Refunds

Our return and refund process is detailed in our Refund Policy. Briefly: we cover defects, damage, lost packages, and wrong items received. We offer one size exchange per order. We don't accept returns for change of mind.

8. Intellectual Property

All designs, graphics, photos, copy, and brand elements on the Site are the property of ClickGear LLC, our partners, or licensors, and are protected by US and international copyright, trademark, and other intellectual property laws.

You may not reproduce, copy, distribute, sell, or create derivative works from any PopFerry content without written permission. Buying a PopFerry product gives you ownership of that physical item, not the design printed on it.

The PopFerry name and logo are trademarks of ClickGear LLC.

9. User-Generated Content (Reviews and Submissions)

When you submit a review, photo, comment, or any other content to the Site, you grant PopFerry a perpetual, worldwide, royalty-free, non-exclusive license to use, edit, reproduce, publish, and display that content in connection with our business, including in marketing materials, social media, and on the Site.

You represent that any content you submit is your own original work, doesn't infringe on anyone else's rights, and doesn't contain anything illegal, defamatory, hateful, or sexually explicit.

We may edit submitted content for length, clarity, or to remove inappropriate material, while preserving the substance of your feedback. We may also decline to publish submissions at our discretion.

If at any time you feel that a published version of your review misrepresents your original feedback or your experience with PopFerry, please reach out to us at info@popferry.com. We're happy to discuss the edit with you, restore your original wording, or remove the review entirely. No questions asked. Your voice matters more to us than the review.

10. Email and Marketing Communications

By creating an account, subscribing to our newsletter, or opting in at checkout, you consent to receive marketing emails from PopFerry, which may include product launches, sales, restocks, and editorial content. You can unsubscribe at any time using the link in any email or by contacting us.

Transactional emails (order confirmations, shipping updates, customer service replies) are not considered marketing and will be sent regardless of marketing opt-in status.

11. Prohibited Uses

You agree not to use the Site to:

- Violate any law or regulation
- Infringe on PopFerry's or any third party's intellectual property
- Submit false, misleading, or fraudulent information
- Transmit viruses, malware, or any harmful code
- Attempt to gain unauthorized access to any part of the Site
- Scrape, copy, or harvest data from the Site without permission
- Resell PopFerry products without written authorization
- Use the Site for any commercial purpose other than personal shopping

We may suspend or terminate your access for any violation of these Terms.

12. Disclaimers

The Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, PopFerry disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We don't guarantee that the Site will always be available, error-free, or secure. We don't warrant that products will meet every customer's specific expectations.

13. Limitation of Liability

To the fullest extent permitted by law, PopFerry, its officers, members, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, even if we've been advised of the possibility of such damages.

Our total liability for any claim related to your order or your use of the Site is limited to the amount you paid for the order at issue.

Some jurisdictions don't allow these limitations, so they may not apply to you in full.

14. Indemnification

You agree to indemnify and hold harmless ClickGear LLC, its officers, members, employees, and partners from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your infringement of any third party's rights.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.

16. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

If you have a dispute with PopFerry, we ask you to first contact us at info@popferry.com so we can try to resolve it directly. Most issues can be solved this way.

If we can't reach a resolution, you and PopFerry agree that any dispute, claim, or controversy arising from or relating to these Terms, the Site, or your purchase will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Wyoming or remotely.

Exception: Either party may bring an individual claim in small claims court if it qualifies under that court's rules.

Class action waiver: You and PopFerry agree that any dispute will be resolved on an individual basis only. You waive your right to participate in a class action, class arbitration, or representative proceeding.

17. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated through the Site or by email if you have an account. Continuing to use the Site after changes take effect means you accept the updated Terms.

18. Severability

If any part of these Terms is found to be unenforceable, the remaining parts will stay in full force and effect.

19. Entire Agreement

These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, make up the complete agreement between you and PopFerry regarding your use of the Site.
